Characteristics

These general terms and conditions of sale apply to all orders of products sold by the seller on their website. The general terms and conditions of sale can be consulted on the website and are accepted by the customer prior to placing any order.

They are applicable in their entirety for any order placed on the seller’s website and its customers in France or abroad, regardless of the place of execution and/or delivery.

The seller and the customer agree that these general terms and conditions of sale exclusively govern their relationship.

Ordering on the Website

The customer has the option to place their order online using the form provided.

For the order to be validated, the customer must accept these general terms and conditions of sale by clicking in the indicated place. Any order on the website carries an obligation to pay and constitutes acceptance of the prices and descriptions of products available for sale.

In certain cases, particularly in the event of payment default or other issues with the customer’s account, the seller reserves the right to block the customer’s order until the problem is resolved.

In case of unavailability of the ordered product, the customer will be informed by email. The cancellation of the order for this product and its potential refund will then be processed.

Ordering on Vimeo

Whenever a duly registered User wishes to rent or purchase a Program, they must click on the button “Rent for xxx €” (xxx corresponding to the VAT-inclusive selling price), or “Buy for xxx €”. A summary page of the chosen Program’s characteristics will be presented, indicating in particular the price to be paid and requesting validation. Each rental or purchase is subject to a detailed invoice indicating the program name, its rental or purchase date, and its VAT-inclusive price. Each invoice can be viewed in the “My Account” area of each user in the “Billing History” section. If the film was rented on a third-party site such as Vimeo, the invoice is available on the third-party site.

The User then commits to scrupulously respect the rights of the authors and rightsholders of the ordered audiovisual Program, particularly by not attempting in any way to copy it again, transfer it and/or alter it by any means, especially by violating the management or security rules attached to the downloaded files. Failure to do so would expose the User to sanctions under the legal provisions in force. The Site reserves the right to modify, temporarily or permanently interrupt all or part of one (or more) available Program(s) at any time. The Site makes no commitment to maintain permanent and uninterrupted access to the Programs, particularly in accordance with the requirements of the Programs’ rightsholders.

Product Information

The products governed by these general terms and conditions of sale are those that appear on the seller’s website and are indicated as sold by the seller.

The products are described and presented with the greatest possible accuracy. However, if errors or omissions have occurred in this presentation, the seller’s liability cannot be engaged. The photographs of the products are not contractually binding.

Price

The seller reserves the right to revise its rates at any time but commits to apply the rates in effect indicated at the time of the order, subject to availability on that date.

Prices are indicated in euros. They do not include delivery charges, which are billed additionally and indicated before order validation. Prices include VAT applicable on the day of the order.

Payment of the total price must be made at the time of the order. At no time will the amounts paid be considered as deposits or down payments.

Payment Methods

Payment is made online through a secure payment system. The seller does not collect your banking data and has chosen well-known banking institutions ensuring a sufficient level of security. You can pay by credit card or via PayPal.

The seller reserves the right to suspend any order processing and delivery in case of refusal of payment authorization by credit card from officially accredited organizations or in case of non-payment. The seller particularly reserves the right to refuse to make a delivery or honor an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is currently being administered.

Complaints

The customer must address any complaint of non-conformity or defect of products in nature or quality to the seller.

Absence of Right of Withdrawal

The video-on-demand service constitutes an intangible service provided exclusively by digital means. In accordance with Article L.221-28 of the Consumer Code, once viewing has begun, the User will no longer have the ability to exercise their right of withdrawal or request a refund as a result. As the rental or purchase of this Program via download is for immediate delivery and execution, the User will therefore not be able to benefit from the right of withdrawal or request any refund, which they expressly acknowledge and accept by validating these general conditions.

Temporary Rental on Vimeo

The rental allows the viewing of a program for a duration of twenty-four (24) hours from the start of playback, without viewing limitation during this period.

You can watch the video you have purchased immediately, or at any time during the indicated viewing period. Simply log in to Vimeo On Demand and click on Purchases in the top navigation bar to access your active rentals, subscriptions, and purchases.

Restrictions for On Demand Content

Location Restrictions

Some content may have different distribution agreements for different regions of the world. This is why some content on vimeo.com/ondemand is only available for purchase in certain countries.

If the content you want to watch is currently not available in your region, you can contact the creator for more information (via the Message button on the content’s Vimeo On Demand page). They may be able to tell you when you will be able to watch the content in your country.

Streaming Restrictions

Some Vimeo On Demand content can only be viewed on one device at a time. There are also limits on the number of different content that can be streamed simultaneously on different devices. If you encounter the error ‘Stream Limits: Too many streams are open simultaneously’ in the player, reduce the number of simultaneous streams on your account.

Remove Device Authorization

If you see the error message Device Limit: You have reached the maximum number of authorized devices, you will need to cancel the authorization of one of your devices to authorize the new one.

Follow these steps to cancel a device’s authorization:

  • Go to My Settings on Vimeo
  • Authorized devices will appear at the bottom of this page
  • Click on the green button next to the authorized device you wish to remove
  • You can now authorize a new device

Please note that you can only remove the authorization of two devices during a 90-day period.

Intellectual Property

The photographs produced by the seller and sold on their website are and remain the intellectual property of the seller according to the rules of Articles L 121-1 and following of the Intellectual Property Code. The rights to photographs transmitted on physical or digital media are strictly limited to use within a private context. Any public projection is prohibited and subject to prosecution.

Any use of photographs taken by the seller beyond this usage and without their written authorization constitutes infringement under Article L 335-2 of the same Code, and is punishable, pursuant to this article, by penalties of up to 3 years imprisonment and a fine of €300,000.

Partial Non-Validation

If one or more provisions of these general conditions are held to be invalid or declared as such under a law, regulation, or following a final decision by a competent court, the other provisions will retain their full force and effect.

Non-Waiver

The fact that one party does not invoke a breach by the other party of any of the obligations referred to in these general terms and conditions of sale shall not be interpreted for the future as a waiver of the obligation in question.

Applicable Law and Disputes

These Terms and Conditions are subject to French law.

Any dispute between the parties relating to its interpretation and/or execution will be submitted, in the absence of an amicable resolution, to the Commercial Court of Paris where the client may initiate proceedings.

Technical Conditions for Accessing the Service

On a Computer

  1. To watch your VOD purchases on a computer, log into your Vimeo account in your desktop browser and go to Purchases (purchases also appear in your Watch Later list).
  2. Click on content in the purchases to access its VOD page, from which you can watch the video(s).
  3. To go full screen, click the full screen icon in the bottom right corner of the player.

On a Television

You can stream videos via AirPlay or Chromecast to a supported television from your mobile device or web browser. For more information, see the article “How to stream videos via AirPlay or Chromecast?”

Once you have access to Vimeo on your device, log into your account and go to your Watch Later list: all Vimeo On Demand content you have purchased or rented will automatically appear there.

On a Smartphone or Tablet

You have two options for viewing purchased videos on your mobile device:

  • Mobile app: Download the Vimeo mobile app on your phone or tablet. In the app, log into Vimeo, then go to your Watch Later list under your profile picture in the top right corner, where you’ll find your purchased videos. You can also find your purchased content in Purchases, in the library.
  • Mobile site: Open the web browser and go to vimeo.com on your phone or tablet. Log into Vimeo, tap the “v” icon (in the top left corner of the page), then choose Watch Later to see all the content you’ve purchased.

Although it’s not possible to download a video from Vimeo to your phone, our mobile app allows you to save videos for offline viewing.
